Babysitter Broker

Terms & Conditions

Effective date: September 18, 2026

Babysitter Broker is a technology and matching service. Unless expressly stated otherwise, Babysitter Broker is not the employer, agency, representative, or guarantor of any parent, guardian, babysitter, nanny, caregiver, or other user.

About these Terms

These Terms & Conditions (the "Terms") govern access to and use of the Babysitter Broker website, mobile or web application, messaging services, and related services (collectively, the "Service"). The Service is operated by Babysitter Broker ("Babysitter Broker," "we," "us," or "our"). By creating an account, accessing the Service, or using any feature of the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use the Service as a parent, guardian, or caregiver.

You agree to provide accurate, current, and complete account information and to keep your phone number, contact information, household information, availability, and other profile information reasonably current.

You are responsible for safeguarding access to your account and for activity occurring through your account. You may not impersonate another person, create an account for fraudulent purposes, or allow unauthorized use of your account.

Babysitter Broker may use phone-number verification, invitation context, network connections, or other measures to support account integrity and community safety.

2. The Broker and Matching Service

The Service may allow a parent or guardian to submit a childcare request through an in-app Broker interface, structured request form, voice or text input, or supported SMS feature. The Broker may use information such as date, time, duration, children involved, location, notes, sitter preferences, network relationships, availability, and request urgency to identify potentially eligible caregivers.

For ordinary requests, the Service may contact or present the request to eligible caregivers sequentially and may use response windows. For urgent requests, the Service may contact multiple eligible caregivers at the same time, and a request may be assigned to the first eligible caregiver who accepts, subject to the Service's confirmation logic.

Caregivers may provide availability, location or travel preferences, and information about the families or types of requests they are willing to consider. Caregivers do not receive a guarantee of work, and parents do not receive a guarantee that a caregiver will be available.

Matching, ranking, suggested caregivers, network relationships, or Broker outputs are tools to assist users. They are not endorsements, certifications, guarantees, or determinations that any individual is suitable for a particular childcare arrangement.

3. Childcare Arrangements Are Between Users

Any childcare engagement is an arrangement directly between the parent or guardian and the caregiver. Users are responsible for communicating expectations, compensation, schedules, transportation, household rules, emergency information, allergies, medical considerations, and any other terms relevant to the sit.

Babysitter Broker does not set or collect caregiver compensation unless a separate payment feature is expressly introduced and governed by additional terms. Where users pay one another outside the Service, Babysitter Broker is not a party to that payment.

Parents and guardians are responsible for deciding whether a caregiver is appropriate for their family. Caregivers are responsible for deciding whether to accept a request and whether they can safely and lawfully provide the requested care.

4. Screening, References, Reviews, and User Information

Profiles may contain information supplied by users or derived from permitted network activity, such as education, experience, community affiliations, mutual connections, reviews, family details, and availability. Users must not knowingly submit false, misleading, defamatory, or unauthorized information.

Unless the Service expressly states that a particular verification or background check has been completed, users should not assume that Babysitter Broker has independently verified identity, credentials, criminal history, driving history, references, certifications, employment history, or other profile claims.

If Babysitter Broker later offers background checks, identity verification, reference verification, or similar services, additional disclosures and terms may apply. No screening method can guarantee a person's future conduct.

5. Family, Child, Home, and Safety Information

Parents and guardians may provide information about children, household members, home location, routines, allergies, care instructions, emergency contacts, or other information needed to facilitate childcare. You represent that you have authority to provide this information.

Users may access sensitive family or home information only for legitimate purposes connected to a current or upcoming childcare arrangement. Users may not copy, retain, disclose, publish, or use such information for unrelated purposes.

Babysitter Broker may limit or remove access to detailed child, household, or address information after a childcare engagement has ended, or whenever necessary for privacy or safety.

6. Messaging, Calls, SMS, and Notifications

You may be able to communicate through in-app messaging, phone calls, push notifications, email, or SMS. If Babysitter Broker offers "Text the Broker," messages sent from the verified phone number associated with your account may be linked to your account and processed through the same underlying Broker and request workflow as in-app communications.

SMS program description: recurring service-related text messages from The Babysitter Broker about babysitting requests, responses, confirmations, schedule changes, cancellations, invitations, and account activity. The Babysitter Broker does not send marketing or promotional text messages.

Recurring text messages are optional and off by default. They begin only after you take an affirmative action in the web-based notification preferences shown in the "Stay in the loop" step after onboarding, or later under Settings, where the full disclosure is displayed before your opt-in is stored. Consent is not required to create, purchase, or use an account, and is never bundled with acceptance of these Terms, the Privacy Policy, or account creation. One-time verification codes used to sign in are a separate matter: they are sent only when you yourself request access to your account, and receiving them is not consent to recurring messages.

Message frequency varies and depends on your own activity. Message and data rates may apply according to your mobile plan. Carrier delivery is not guaranteed, and carriers are not liable for delayed or undelivered messages.

Reply HELP to any text message from The Babysitter Broker for help, and STOP to stop receiving recurring text messages. You may also turn text messages off under Settings → Settings. Support: support@thebabysitterbroker.com. Information about your mobile number and text-message consent is handled as described in our Privacy Policy, and the full opt-in flow is shown at /sms-consent.

7. Invitations and Networks

The Service may allow users to invite contacts, establish connections, or see how people are connected through other users. You may only invite or provide contact information for people when you have a lawful and appropriate basis to do so.

Network connections are contextual signals and do not constitute endorsements or guarantees. You are responsible for evaluating people with whom you connect.

Babysitter Broker may use privacy-preserving measures, minimum connection thresholds, progressive disclosure, or other controls before displaying certain information.

8. Subscriptions, Trials, and Billing

Babysitter accounts may be offered without a subscription fee. Parent or guardian access may be subject to a paid subscription, free trial, promotional period, referral credit, or other plan described at the time of enrollment.

If a paid plan is offered, the price, billing interval, renewal terms, trial terms, and method for canceling will be disclosed before purchase. Unless otherwise stated at purchase, subscriptions may automatically renew until canceled in accordance with the checkout disclosures and applicable law.

Babysitter Broker may offer promotions, including referral or invitation incentives. Eligibility, duration, and requirements for promotions may vary and may be changed or discontinued prospectively, subject to applicable law.

App-store or third-party billing may be subject to the payment provider's additional terms and refund rules.

9. Cancellations and Changes

Parents and caregivers are responsible for promptly communicating cancellations, schedule changes, delays, or emergencies. The Service may provide tools for editing or canceling requests, but Babysitter Broker does not guarantee that another caregiver can be found after a cancellation.

Repeated misuse, intentional no-shows, abusive cancellations, or manipulation of the request process may result in restrictions or suspension.

10. Prohibited Conduct

You may not use the Service to harass, threaten, exploit, discriminate unlawfully, stalk, defraud, impersonate, or harm another person; solicit illegal services; distribute malware; scrape or harvest data; bypass security or privacy controls; misuse child or household information; or use the Service for purposes unrelated to legitimate childcare and community functions.

You may not use another user's personal information obtained through the Service for advertising, unrelated solicitation, publication, background investigations outside permitted Service features, or any other unauthorized purpose.

11. Emergencies

The Service is not an emergency service and is not a substitute for 911, emergency medical services, law enforcement, poison control, or other emergency resources. In an emergency, contact the appropriate emergency service directly.

12. Intellectual Property

The Service, including its software, design, branding, Broker interfaces, text, graphics, and other content provided by Babysitter Broker, is owned by or licensed to Babysitter Broker and is protected by applicable intellectual-property laws.

Subject to these Terms, Babysitter Broker grants you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purposes.

13. User Content

You retain ownership of content you submit, subject to the rights necessary for Babysitter Broker to operate the Service. You grant Babysitter Broker a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and transmit your content solely as reasonably necessary to provide, secure, improve, and support the Service and as otherwise described in the Privacy Policy.

You represent that you have the rights and permissions necessary to submit your content.

14. Suspension and Termination

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

Babysitter Broker may suspend, restrict, or terminate access when reasonably necessary to protect users, investigate suspected misconduct, comply with law, address nonpayment, enforce these Terms, or protect the integrity of the Service. Where appropriate, we may preserve records needed for safety, fraud prevention, dispute resolution, or legal compliance.

15. Third-Party Services

The Service may rely on third parties for hosting, authentication, communications, analytics, maps, address search, notifications, payment processing, app distribution, customer support, or other functionality. Third-party services may have their own terms and privacy practices.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Babysitter Broker disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Babysitter Broker does not warrant that a particular caregiver or family is safe, suitable, reliable, qualified, or available; that a request will be accepted; that user-supplied information is accurate; or that the Service will be uninterrupted or error-free.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by law, Babysitter Broker and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from or related to the Service or a childcare arrangement.

To the maximum extent permitted by law, Babysitter Broker's aggregate liability arising from or relating to the Service will not exceed the greater of (a) the amount you paid to Babysitter Broker during the 12 months before the event giving rise to the claim or (b) $100.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Babysitter Broker and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your misuse of the Service, your violation of these Terms, your violation of another person's rights, or a childcare arrangement in which you participate, except to the extent caused by Babysitter Broker's own conduct for which indemnification may not lawfully be required.

19. Disputes and Governing Law

These Terms are governed by the laws of the state in which Babysitter Broker is legally organized, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Venue, arbitration, class-action waiver, and other dispute-resolution provisions can materially affect legal rights and should be finalized with counsel based on Babysitter Broker's state of organization and launch strategy. Until finalized, this draft does not impose mandatory arbitration or a class-action waiver.

20. Changes to the Terms

We may update these Terms as the Service evolves or laws change. We will post the updated Terms and update the effective date. If required by law, we will provide additional notice or obtain consent before material changes take effect.
